You may opt in to receive text messages from OptimizeTX by checking the SMS consent box on a form on our website, by providing your mobile number and consent verbally or in writing to a member of our team, or by texting us first. Consent to receive marketing text messages is not a condition of purchasing any goods or services from us.
4.2 What We Send
Depending on the consent you provide, messages may include appointment scheduling and reminders, responses to your inquiry, care team follow-ups, notifications that results are ready, service updates, and promotional offers.
4.3 Message Frequency and Cost
Message frequency varies. Message and data rates may apply. Consult your mobile carrier for details about your plan.
4.4 How to Opt Out or Get Help

4.5 How We Protect Your Mobile Information
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All of the categories of sharing described in Section 5 below exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
We share your mobile number only with the service providers that are strictly necessary to deliver the messages you have asked to receive, such as our messaging platform and telecommunications carriers. These providers are contractually restricted from using your information for their own marketing purposes.
5. How We Share Your Information
We do not sell your personal information. We share personal information only in the following limited circumstances:
- Service providers: companies that perform services on our behalf, such as website hosting, customer relationship management, email delivery, messaging delivery, scheduling, analytics, and payment processing. They may access your information only to perform those services for us.

- Legal and safety reasons: when we believe disclosure is required by law, subpoena, or legal process, or is necessary to protect the rights, property, or safety of OptimizeTX, our clients, or others.

Text messaging originator opt-in data and consent are excluded from every category above and are never shared with any third parties for marketing or promotional purposes.
6. Protected Health Information and HIPAA
Information you submit through a website form before you become a client is contact and inquiry information, not a medical record. Once you become a client of OptimizeTX, health information created or received in the course of providing care is handled in accordance with applicable federal and state law, including the Health Insurance Portability and Accountability Act (HIPAA) where it applies, and is governed by our Notice of Privacy Practices, which is provided to clients at the start of care.
Please do not include detailed medical information, diagnoses, or sensitive health details in website forms, unsecured email, or text messages. Standard email and SMS are not fully secure methods of communication.
7. Cookies, Analytics, and Advertising
We use cookies and similar technologies to operate our website, remember your preferences, measure traffic, and evaluate our marketing. We may use tools such as Google Analytics, Google Tag Manager, Google Ads, and the Meta (Facebook and Instagram) pixel.
These tools may collect information about your visit and, in some cases, allow us to show you ads on other websites and platforms. You can:

Our website does not currently respond to “Do Not Track” browser signals.

Opting out of marketing messages does not stop transactional communications related to care you are already receiving, such as appointment confirmations or results notifications.
8.2 Nevada Residents
Nevada law (NRS Chapter 603A) gives Nevada consumers the right to submit a verified request directing a website operator not to sell certain personal information. OptimizeTX does not sell personal information. To submit a request, email info@optimizetreatment with the subject line “Nevada Do Not Sell Request.”
8.3 California Residents
If you are a California resident, you may have the right to know the categories and specific pieces of personal information we have collected about you, to request deletion or correction of that information, and to not be discriminated against for exercising these rights. We do not sell or share personal information for cross-context behavioral advertising as those terms are defined under California law. Submit requests to info@optimizetreatment.

We retain personal information for as long as necessary to provide our Services, maintain business and medical records, comply with our legal, professional, and regulatory obligations, resolve disputes, and enforce our agreements. Medical records are retained for the period required by Nevada law. Marketing and inquiry records are retained until you ask us to delete them or until they are no longer needed for the purpose for which they were collected.
Records of your text messaging consent and any opt-out request are retained for as long as required to demonstrate compliance with telecommunications regulations.
10. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping any account credentials confidential.
