OptimizeTX provides concierge healthcare services in the Las Vegas Valley, including Las Vegas, Henderson, Boulder City, Cadence, Foothills, and Seven Hills, Nevada.
2. Eligibility
You must be at least 18 years old and legally able to enter into a binding agreement to use our Services. Our Services are offered only to individuals located in areas we serve. By using the Services, you represent that you meet these requirements and that the information you provide is accurate and belongs to you.
3. No Medical Advice and No Provider-Patient Relationship
The content on our website, including text, graphics, videos, testimonials, and downloadable material, is provided for general informational purposes only. It is not medical advice and is not a substitute for professional diagnosis or treatment.
Submitting a form, requesting an assessment, or communicating with us through the website does not create a provider-patient relationship. A provider-patient relationship is established only after you complete our intake process, are evaluated by a licensed provider, and formally engage our services.

Fees for programs and services are disclosed to you before you enroll. Unless otherwise agreed in writing, payment is due at the time services are rendered or according to the payment schedule in your service agreement. We do not bill health insurance for concierge program fees. You are responsible for determining whether any portion of your care is eligible for reimbursement by your insurer, HSA, or FSA.
9. Text Messaging Program Terms (SMS and MMS)
By providing your mobile phone number and giving your express written consent, you agree to receive text messages from OptimizeTX. These messaging terms are part of these Terms and Conditions.
9.1 Program Description
OptimizeTX sends text messages to individuals who have opted in. Depending on the consent you have provided, messages may include:

- Appointment scheduling, confirmations, reminders, and changes
- Care team follow-ups and check-ins
- Notifications that laboratory results are available
- Service updates and account notifications
- Promotional offers, news, and marketing messages, where you have consented to receive them
9.2 How to Opt In
You may opt in by checking the SMS consent box on a form on our website, by giving your mobile number and consent verbally or in writing to a member of our team, or by texting us first. Consent to receive marketing text messages is not a condition of purchasing any goods or services.

9.4 Cost
Message and data rates may apply. Your mobile carrier’s standard messaging and data rates will apply to each message sent and received. Contact your carrier for details about your plan.
9.5 Opting Out
You can cancel the SMS service at any time by replying STOP to any message you receive from us. After you send STOP, we will send you a single confirmation message and will not send any further text messages unless you opt in again. If you want to rejoin, sign up as you did the first time and we will resume sending messages.

9.7 Supported Carriers and Delivery
Carriers are not liable for delayed or undelivered messages. Delivery of messages is subject to effective transmission by your mobile carrier and is outside our control. We do not guarantee that messages will be delivered to your device.

You represent that you are the account holder or authorized user of the mobile number you provide, and that you are at least 18 years old. You agree to notify us promptly if your mobile number changes or is reassigned, so that we do not send messages to a person who has not consented to receive them.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to your use of the website will not exceed one hundred dollars (USD $100.00). This section does not apply to claims arising from professional healthcare services rendered to an established client, which are governed by applicable Nevada law and your service agreement.

You agree to indemnify, defend, and hold harmless Optimization, LLC and its owners, officers, employees, contractors, and agents from any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your misuse of the Services, your violation of these Terms, or your violation of the rights of any third party.
18. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Nevada, without regard to its conflict of laws principles. You agree that any dispute arising out of or relating to these Terms or the website will be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the jurisdiction of those courts. Nothing in this section affects any dispute resolution provisions contained in a separate service agreement between you and OptimizeTX.

If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision.
